$265 Million Settlement in Amtrak Train No. 188 Derailment
In May 2015, Amtrak train No. 188, traveling to New York City, sped around a curve in Philadelphia and derailed, causing over 200 injuries, including eight deaths. An investigation by the National Transportation Safety Board concluded the crash was caused by the engineer mistakenly accelerating around the curve instead of decelerating.
Working as part of the Plaintiff’s Management Committee to handle the Multi-District Litigation, Todd and Fred Eisenberg were able to secure a historic $265 million settlement to ensure that all victims would be compensated for their injuries and losses in a timely manner.
It is believed to be the largest such settlement in railway history.
$24.8 Million Verdict in Construction Accident Case
Todd was part of the Eisenberg Winkler Jeck Schwartz Schoenhaus & Sherry team that secured a $24.8 million jury verdict in a construction case where our client, working alone on the roof of an auto body shop, tripped and fell 25 feet through a skylight onto the concrete floor below. As a result of this accident, he suffered severe and permanent brain damage.
$12.75 Million Settlement in Automobile Accident Case (Confidential)
Todd and Nancy Winkler secured a confidential $12.75 million settlement in an automobile accident case where our client suffered catastrophic quadriplegic injuries when she was a passenger in a vehicle that was rear-ended by a truck as her vehicle was pulling over onto a highway shoulder.
$9.25 Million Settlement in Construction Accident Case (Confidential)
Todd and Nancy Winkler secured a confidential $9.25 million settlement in a case where our client fell from the second story of a newly constructed home while attempting to carry a large piece of sheetrock across an unguarded opening. – Todd and Fred Eisenberg secured a $9 million settlement as trial was set to begin in a case where our client’s car was struck in a head-on collision with a tractor-trailer when the truck crossed the center line. The truck driver had a history of medical issues and safety violations, was overly fatigued, and should not have been permitted by his employer to operate a commercial vehicle. Our client, a single mother, suffered a traumatic brain injury and broke multiple bones, rendering her permanently disabled.

$4.7 Million Jury Verdict in Undiagnosed and Untreated Coronary Artery Disease Case
Todd and Dan Jeck secured a $4.7 million jury verdict in a case where our client died because of undiagnosed and untreated coronary artery disease weeks after multiple visits to an urgent care center that did not refer him to a cardiologist despite his complaining of chest pain and other cardiac symptoms.
$3.35 Million Settlement in Prison Suicide Civil Rights Case
Todd and Nancy Winkler secured a $3.35 million settlement for the parents of a Pennsylvania Department of Corrections inmate who hung himself while on suicide watch. Facing allegations of constitutional violations for a deliberate indifference to serious medical needs, the Department paid a then-record amount and also agreed to certain policy changes.
$2.5 Million Verdict in Medical Malpractice Case
Todd and Joshua Schwartz secured a $2.5 million jury verdict for the family of a 75- year-old double amputee who died after falling out of his wheelchair following an eye examination involving dilation and an antibiotic ointment. Todd and Josh convinced the jury that the patient should not have been discharged with temporarily impaired eyesight, given his wheelchair dependence and underlying amputations.
Education and Experience in Personal Injury Law
Todd graduated with distinction from the University of Michigan in 1994 with a Bachelor of Arts in Political Science. He then earned his law degree from the University of Michigan Law School in December 1996. While in school, he served as an Associate Editor of the University of Michigan Journal of Law Reform, and received several writing and advocacy awards.
Before joining our law firm in 2012, Todd was a litigation partner in an international law firm, where he spent a decade litigating a wide array of tort matters on behalf of individuals and companies throughout the country.
