Stewart Eisenberg, Nancy Winkler, and Dan Sherry recently secured a confidential nearly eight-figure settlement in a lawsuit on behalf of the mother of a 25-year-old man who died after succumbing to injuries he suffered in a single commercial vehicle crash. Our client alleged a defective tire on the steer axle of the vehicle her son was driving catastrophically failed, causing the accident that killed him.
Our client brought her lawsuit against a number of defendants, including those that designed, manufactured, and distributed the allegedly defective tire, as well as the defendant that allegedly improperly inspected and evaluated it.
“Our client’s son was an extraordinary person whose death caused a considerable void in the lives of all who knew him,” said Nancy. “He had decades of life to live that were taken from him and his family through no fault of his own.”
“Parents should not have to bury their children, and no amount of money will bring our client’s son back into her life,” added Dan. “But with this settlement, justice has been served and, perhaps, future lives will be saved.”
The settlement followed almost three years of intense litigation in the case, including months of venue discovery, and hundreds of pages of associated supplemental briefings. In addition, Stewart, Nancy, and Dan achieved this excellent result in the midst of a court shutdown due to the COVID-19 pandemic. They pursued justice on behalf of a grieving mother and achieved a multimillion-dollar result under difficult circumstances.
