Last week, U.S. District Judge Mark Kearney of the Eastern District of Pennsylvania agreed with arguments made by our Nancy Winkler and Todd Schoenhaus and rejected Johnson & Johnson’s attempts to move our client’s Talc-related lawsuit to a federal bankruptcy court in Delaware.
With Judge Kearney’s ruling, our client’s case will head back to state court in Philadelphia. This means that the case will almost certainly be the first talc-related case to be tried before a Philadelphia jury.
In the lawsuit, our client Ellen Kleiner alleges that her ovarian cancer was caused by the talc in Johnson & Johnson’s baby powder.
Nancy told The Legal Intelligencer that she hopes that “other judges in the Eastern District and across the country follow Judge Kearney and numerous other judges who have remanded cases, and remand the cases of these brave women to state court so their cases can be tried without delay.”
