“Proving Permanent Injuries” at New Jersey Association for Justice Boardwalk Seminar 2023

On April 27, Eisenberg Winkler Jeck Schwartz Schoenhaus & Sherry, P.C. shareholders Nancy Winkler and Dan Jeck presented a program titled “Proving Permanent Injuries” to New Jersey Association for Justice members during the organization’s Boardwalk Seminar 2023 event.

During their program, Nancy and Dan, along with co-presenter Mark S. Wagner, Ph.D., ABN, FACPN, ABVE, explored techniques lawyers and medical experts can use to educate, explain, and prove to judges and juries that those lawyers’ clients suffered significant permanent injuries, such as traumatic brain injuries, when those clients do not appear at first glance to be injured at all.

“Sometimes, people suffer permanent, debilitating injuries as the result of someone else’s misconduct, but to the untrained eye these people do not appear to be injured,” said Nancy. “Under the law, people are to be compensated for the economic and non-economic damages they incur because of their injuries and not for how injured they appear to be. Our presentation focused on strategies for making sure judges and juries understand that just because someone doesn’t appear to be seriously injured doesn’t mean they’re not.”
